Michael Marcus was honored in December 2007 by the Daily
Journal Corporation (the publisher of the Sacramento
Recorder,
the Los Angeles Daily Journal and
the San
Francisco Daily Journal) as one of California's 40
best mediators and arbitrators.
Michael Marcus has arbitrated matters involving commercial disputes, wrongful termination, legal malpractice, medical malpractice, personal injury and legal fee disputes. His trial
experience as both a judge and lawyer and knowledge of evidence are very helpful to the satisfactory resolution of these disputes.
Michael Marcus has mediated
more than 1300 cases involving
employment issues (unlawful termination, race and age discrimination,
sex harassment, failure to accommodate disabilities and wage
and hour violations), legal malpractice, personal injury (automobile,
premises liability, wrongful death, environmental/toxic tort,
dog assaults), commercial disputes (breach of contract, fraud,
breach of fiduciary duty, accounting irregularities), medical
malpractice, police misconduct, construction defect and real
property (easement, eminent domain, neighbor v. neighbor disputes,
inverse condemnation).
While bringing an evaluative approach to mediations, Judge Marcus understands that every case is unique and must be approached differently. His intensive preparation, knowledge of the litigation system and ability to communicate lead to a high percentage of settlements.
Judge Marcus was honored by the Los
Angeles Superior Court in 2007 for his contributions to the Court's Alternative Dispute
Resolution Program.
